1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction to use Instant Quote Creator. By creating an account, you represent that you meet these requirements and that the information you submit is accurate.

2. Account registration

You agree to provide accurate, current, and complete information during registration and to keep that information updated.
You are responsible for safeguarding your credentials and for all activity that occurs under your account.
You must notify us immediately of any unauthorized access at legal@instantquotecreator.com.
One account per individual or business entity unless otherwise agreed in writing.

3. User responsibilities

You will use the service only for lawful purposes and in compliance with these Terms.
You will not interfere with the operation of the service, attempt to gain unauthorized access, or reverse-engineer the platform.
You are solely responsible for the content you upload, generate, or transmit, including quotes, invoices, marketing, and AI-assisted outputs.

4. Subscription billing

Paid plans are billed in advance on a monthly or annual recurring basis through our payment processor (Stripe).
Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
Prices may change with at least 30 days' notice; changes apply to the next billing cycle.
Failed payments may result in suspension of access after a grace period.

5. Lifetime plan terms

A 'lifetime' plan grants access to the core platform features for the operational life of the service, subject to fair use and these Terms.
Lifetime does not guarantee perpetual operation; if the service is discontinued, no further obligation is owed once a reasonable wind-down period has elapsed.
Lifetime plans are non-transferable, may exclude certain add-ons, and may have usage limits to prevent abuse.
Future modules may require a separate purchase.

6. Payment terms

All fees are in the currency displayed at checkout and exclusive of applicable taxes unless stated. You authorize us and our processor to charge your selected payment method for all fees incurred. You are responsible for any bank, card, or currency-conversion fees.

7. Refund policy

Refunds are governed by our separate Refund Policy. In short: monthly plans are non-refundable after the billing date; annual plans may be refunded pro-rata within 14 days for EU/UK consumers; lifetime plans may be refunded within 14 days of purchase, less any usage credits consumed.

8. Chargebacks

Initiating a chargeback without first contacting us at legal@instantquotecreator.com is a breach of these Terms. We reserve the right to suspend or terminate accounts associated with fraudulent or abusive chargebacks and to recover associated fees.

9. Acceptable use

You will not use the service to send spam, conduct illegal activity, harass others, infringe intellectual property, distribute malware, or violate export controls.
You will not use the service to generate, distribute, or facilitate deceptive, misleading, or fraudulent content.
We may suspend or terminate accounts that violate this policy, with or without notice.

10. AI-generated content disclaimer

The service uses AI to assist in generating quotes, content, and recommendations. AI output may be inaccurate, incomplete, or unsuitable for your use case. You are solely responsible for reviewing, verifying, and approving AI-generated content before relying on it. We disclaim all warranties regarding AI output to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Instant Quote Creator and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, or goodwill. Our aggregate liability for any claim arising out of these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Instant Quote Creator, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your content, or your violation of these Terms or any law.

13. Intellectual property

All rights, title, and interest in the service, including software, designs, trademarks, and content provided by us, remain our exclusive property.
You retain ownership of the content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content as necessary to operate the service.
Feedback you provide may be used by us without restriction or compensation.

14. Community rules

Our Community Guidelines apply to all community spaces (Discord, Telegram, forums). Violations may result in removal from those spaces and/or termination of your account.

15. Termination rights

You may cancel your account at any time through your account settings.
We may suspend or terminate your account for breach of these Terms, non-payment, fraud, security risk, or to comply with law.
Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination (e.g., IP, liability, indemnity, arbitration) will survive.

16. Arbitration and dispute resolution

Except where prohibited by law, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration on an individual basis, administered by a recognized arbitration body in the seat of arbitration designated by us. Class actions and jury trials are waived. EU and UK consumers retain all mandatory rights.

17. Governing law

These Terms are governed by the laws of the jurisdiction where Instant Quote Creator is established, without regard to conflict-of-laws principles. Mandatory consumer protections in your country of residence remain unaffected.
